Both of your suggestions are very helpful. It seems that if I were to appeal, it would not be for my upcoming Motion to Dismiss, because I understand that would be an ‘interlocutory’ appeal, and therefore not allowed. I also understand your point about the Judge & OC taking a pro se litigant much more seriously and cutting the nonsense by the very presence of a court reporter. In that respect, it makes a lot of sense in that a reporter may make an appeal unnecessary if the court decides to be reasonable and fair:)

In most cases, the EEOC can file a lawsuit to enforce the law only after it investigates and makes a finding that there is reasonable cause to believe that discrimination has occurred, and is unable to resolve the matter through a process called "conciliation." The EEOC has discretion which charges to litigate if conciliation efforts are unsuccessful, and ultimately litigates a small percentage of all charges filed. When deciding whether to file a lawsuit, the EEOC considers factors such as the strength of the evidence, the issues in the case, and the wider impact the lawsuit could have on the EEOC's efforts to combat workplace discrimination. Congress also gave individuals the right to file a lawsuit in court.

The 30 days allotted by 45 B have elapsed and I have received no response at all, either admitting, denying or objecting to the request. I’m preparing the Motion To Determine Sufficiency, and I will follow your counsel by including a copy of the Request For Admissions, even though I filed a copy with the Court, along with proof of service, on the day I served the request to the defendant’s lawyer. If the Judge grants the motion, issues an Order… well, my case is halfway won. And, I won’t have to drag a handfull of witnesses into court, against their will, to testify. Many times I’ve felt overwhelmed by this, ready to fold my hand even though I know the defendant’s lawyer is bluffing, trying to intimidate me into giving up. Thank you very much for your knowledge, your advice, and your encouragement. I’m thinking I may very well prevail afterall.

Defendants who choose to appear pro se may do so because they believe they may gain tactical advantages against the prosecutor, such as obtaining sympathy from the jury, the opportunity to personally address the jury and witnesses. Pro se appearances may also delay the trial proceedings and enhance the possibility of a mistrial and a subsequent appeal.[49]

Do I have the time and resources available to represent myself pro se? As you can see, there is a lot of learn before representing yourself at a child custody hearing. Parents considering pro se representation should carefully consider whether they have the time, determination, and undivided attention necessary to dedicate to this task before deciding to go it alone in court. 


2. When a particular case is decided, it becomes "precedent" which means that it becomes an example or authority for an identical or similar case or a similar question of law. Court decisions are the basis for the system of stare decisis. These decisions are published in what is called the National Reporter System which covers cases decided by the United States Supreme Court down to the individual state district courts. These reporters each have their own "digest" system which serves as an index by subject on points of law. There are many reporters in this system and they can be found in most law libraries.
Knowing ahead of time that you may encounter a hostile attitude is the best weapon against it. Read and study this book and other legal resources, many of which are available free online or in your local library. Learn how to prepare and present a persuasive case and follow the proper procedures for the Clerk’s Office and the courtroom. If you believe that court personnel at any level are being rude to you, be courteous and professional in ­return, even as you insist upon fair treatment. By knowing and following court rules and courtroom techniques, you can often earn the respect of the judge and the others who work in the courtroom. As a result, you may well find that they will go out of their way to help you.

Remember this phrase: Litigation Privilege. The phrase has a formal meaning, but in layman’s language it means that lawyers can do just about anything, especially to a self-represented litigant, to protect their clients. They can lie, steal, cheat–and kill if they could get away with it–to win. Lawyers don’t always need tricks to defeat pro se litigants, but they try them anyway. They can scare defendants into paying more than they owe or settling for far less than they deserve. They’ll use a request for admissions to make pro se litigants “admit” to undeserved liability by not answering. Some will even attempt to keep away your court reporter by lying to you or to your court reporting agency. So keep your eyes open when you’ve cornered a lawyer. Chances are, there’s a trick coming, and when it does, don’t let your emotions get the best of you. Stay focused on your case. Reacting in anger by moving for sanctions, writing letters to the judge, reporting lawyer behavior in a hearing, or moving to disqualify a lawyer makes thinking and strategizing difficult. That’s not to say certain issues shouldn’t be addressed. If you must take an issue head-on, like moving for sanctions, do it strategically so you’ll get the most out of it. Otherwise, only address lawyer antics and judicial bias when it hurts your case, not when it hurts your feelings.

Relying on expert testimony, counsel for Alberta and Alva Pilliod has accused Monsanto of outright fraud in securing regulatory approval for Roundup. Counsel for Monsanto has tried to undermine expert Charles Benbrook’s testimony by questioning his credentials.


There is virtually no way this guy decided to give it all up at the 11:59th hour for nothing in return. He’d never be able to afford to pay off his attorney, and his attorney wouldn’t take a case that wasn’t collectible this far. We will never known for sure — that’s the nature of confidential settlements — but it’s likely that an attorney and his client got paid VERY well this weekend.
University of Illinois Law School's Professor Robert Lawless, a national expert in personal credit and bankruptcy, showed that, the rate of non-attorney filings in bankruptcy courts by debtors was 13.8% for chapter 13 cases, and 10.1% for chapter 7 cases. The rate was as high as 30% to 45% for major urban areas, such as California and New York city. US Bankruptcy Court of Arizona reported 23.14% cases filed pro se in October 2011, up from 20.61% a year before.[41]
Following the entry of the jury’s verdict, either side may give notice of its intention to appeal. The judgment is prepared by the prevailing side and presented to the court for entry. These post-trial motions usually set out why the jury’s verdict should be disregarded or why the judgment submitted by the other side should be more in keeping with the jury’s verdict. As the initial pleading, a complaint is the most important step in a civil case because a complaint sets the factual and legal foundation for the entirety of a case. While complaints and other pleadings may ordinarily be amended by a motion with the court, the complaint sets the framework for the entire case and the claims that will be asserted throughout the entire lawsuit.
