In October, 2018, the Trump administration filed another motion with the U.S. District Court for the District of Oregon to stay discovery and a third writ of mandamus petition with the Ninth Circuit Court of Appeals. U.S. District Court Judge Ann Aiken ruled on the Trump administration’s motion for judgment on the pleadings (“MJP”) and motion for summary judgment (“MSJ”), which were filed earlier this year. Judge Aiken denied the motions brought by the Trump administration, but granted the motions in part by limiting the scope of the plaintiffs’ claims and dismissing the President from the case. On October 18, 2018, the Trump administration filed a second writ of mandamus petition and application for stay with the U.S. Supreme Court, asking it to circumvent the ordinary procedures of federal litigation and stop the constitutional case Juliana v. United States. On October 19, 2018, the U.S. Supreme Court ordered a temporary, administrative stay while it considers the federal government’s petition and asked plaintiffs to respond to it. On October 22, 2018, attorneys for youth plaintiffs filed their response, requesting that the Court allow their trial to proceed on October 29 and pointing to numerous mischaracterizations of the lawsuit by the Trump administration in its recent filing with the Court.
The disdain by federal judges against pro se litigants is a serious problem in our country, which the Supreme Court and Congress should rectify. Perhaps some judges have seen too many frivolous pro se lawsuits for their liking. Surely many such lawsuits are not meritorious, and the majority are brought by prisoners. Perhaps this is why some judges read only as far as " pro se" before rolling their eyes.
For lawyers, in contrast, the legal system is an array of procedures that begin long before trial (and often continue long afterwards). In fact, few cases ever actually make it to trial. Instead, they settle out of court—or are dismissed—because of these pretrial procedures. Although individually justifiable, collectively these procedures create the potential for adversaries to engage in lengthy “paper wars” that you might find harrowing. Many lawyers are fair and reasonable and will not try to “paper you to death.” Nevertheless, you have to realize from the outset that representing yourself effectively is likely to require a substantial commitment of time—even if your case never goes to trial.

The Legal Services Corporation 2009 report, Documenting the Justice Gap in America, confirms an increase in the number of civil pro se litigants. Due to a lack of government funding, few low-income people can address their legal needs with the assistance of an attorney. As a result, state courts are flooded with unrepresented litigants. To close the gap between the number of people who don’t have access to legal help and those that are lucky enough to work with a legal aid office, the report calls for increased legal aid funding from federal and state governments and private funders and recommends that lawyers contribute additional pro bono services. These developments may be spurred by the U.S. Supreme Court decision in Turner v. Rogers (2012), which suggested that civil court proceedings have to be fundamentally fair, that courts should create forms to help pro se litigants participate fully in the justice system, and hinted that at least in some civil cases, the government may have to provide free legal assistance to parties who cannot afford to hire a lawyer.

Wilson complied, but then sued the federal government through his company, Defense Distributed. The lawsuit claimed the government was infringing on his First Amendment right to free speech by restraining him from posting the files. An Austin-based federal judge declined to issue a temporary injunction that would allow him to upload the files. An appeals court also declined, as did the U.S. Supreme Court.
The Connecticut Supreme Court narrowed criminal defendant's right to self representation, stating that "we are free to adopt for mentally ill or mentally incapacitated defendants who wish to represent themselves at trial a competency standard that differs from the standard for determining whether such a defendant is competent to stand trial". A Senior Assistant State's Attorney explained that the new standard essentially allows judges to consider whether the defendants are competent enough to perform the skills needed to defend themselves, including composing questions for voir dire and witnesses.
Some states have just one kind of trial court, which hears all sorts of cases. In Illinois, for example, circuit courts hear all kinds of disputes. In other states, by contrast, cases that involve less than a certain dollar amount may be tried in one type of court (municipal, city, or justice court, for example), while larger cases go to another type of court (superior, county, or circuit court, for example).
The battle over where to draw the line between religious belief and equal treatment for gay and transgender people remains an open question that the U.S. Supreme Court declined to answer in June when it considered the case of a Colorado baker who refused to make wedding cakes for same-sex couples, saying gay marriage violated his Christian beliefs.
There is virtually no way this guy decided to give it all up at the 11:59th hour for nothing in return. He’d never be able to afford to pay off his attorney, and his attorney wouldn’t take a case that wasn’t collectible this far. We will never known for sure — that’s the nature of confidential settlements — but it’s likely that an attorney and his client got paid VERY well this weekend.

Some courts issue orders against self representation in civil cases. A court enjoined a former attorney from suing the new lover of her former attorney. The Superior Court of Bergen New Jersey also issued an order against pro se litigation based on a number of lawsuits that were dismissed and a failure to provide income tax returns in case sanctions might issue. The Superior Court of New Jersey issued an order prohibiting a litigant from filing new lawsuits. The Third Circuit however ruled that a restriction on pro se litigation went too far and that it could not be enforced if a litigant certified that he has new claims that were never before disposed of on the merits. The 10th Circuit ruled that before imposing filing restrictions, a district court must set forth examples of abusive filings and that if the district court did not do so, the filing restrictions must be vacated. The District of Columbia Court of Appeals wrote that "private individuals have 'a constitutional right of access to the courts', that is, the 'right to sue and defend in the courts'."

Beginning January 1, 2010, Bank of America will no longer participate in the FDIC's Transaction Guarantee Program. Bank of America's decision impacts Merrill Lynch clients enrolled in the Merrill Lynch Bank Deposit Program (MLBDP) Fully FDIC Insured Sweep option. Thus, after December 31, 2009, funds held in the MLBDP Fully FDIC Insured Sweep will no longer be guaranteed in full under the TAG Program, but will be insured up to $250,000 per depositor per Merrill Lynch Affiliated Bank under the FDIC's general deposit rules. As a reminder, since two Merrill Lynch affiliated banks participate in the MLBDP, clients can benefit from FDIC insurance up to $500,000 for individual accounts/$1,000,000 for joint accounts.

A lawsuit begins when a complaint or petition, known as a pleading, is filed with the court. A complaint should explicitly state that one or more plaintiffs seek(s) damages or equitable relief from one or more stated defendants, and also should state the relevant factual allegations supporting the legal claims brought by the plaintiff(s). As the initial pleading, a complaint is the most important step in a civil case because a complaint sets the factual and legal foundation for the entirety of a case. While complaints and other pleadings may ordinarily be amended by a motion with the court, the complaint sets the framework for the entire case and the claims that will be asserted throughout the entire lawsuit.
