This can be a humbling and learning experience.  Sometimes, despite our convictions or our research, there will be times we will miss or misinterpret the point and be wrong.  Thinking law and litigation is a mixture of morality, common sense and fairness is a common source of this experience.  Morality, common sense and fairness may be elements in the drafting of laws, but the implementation of law may not favor morality, common sense or fairness as these terms are generally defined.

Pitting pro se litigants against lawyers as if lawyers are enemies does far more disservice to your clients. I looked at your website, and I see that you toe a fine line between practicing without a license and simply giving pro se litigants enough rope to hang themselves. I understand that it’s a gimmick to make money for yourselves, but the nobler thing to do would be to direct these people to pro bono services instead of guiding them to shooting themselves in the foot by acting like the opposing party’s lawyer is out to get them and that what they don’t understand about the practice of law is somehow a trick or deception.

These systems can help overcome the majority of problems inherent in legal information retrieval systems, in that manual classification has the greatest chances of identifying landmark cases and understanding the issues that arise in the text.[16] In one study, ontological searching resulted in a precision rate of 82% and a recall rate of 97% among legal professionals.[17] The legal texts included, however, were carefully controlled to just a few areas of law in a specific jurisdiction.[18]
Oftentimes, self-represented litigants become reactive when there’s a lawyer on the other side. Instead of getting ahead of things or running their own case, they let the lawyer take the lead. They spend so much time responding to discovery requests, summary judgment motions, motions to dismiss, and other filings that they don’t formulate a strategy of their own. They don’t do their own discovery or object to certain requests because they’re swamped and often intimidated. So, they’re always behind and in a constant reactive state. If a wise opponent sees how reactive you are, they can walk you right into an error. So, take control of your case. Never let a lawyer think that he’s in charge of it.
Do I have a basic understanding of how court procedures work? Custody hearings, and court procedures in general, can be quite confusing for first-timers. Parents considering pro se representation usually benefit from attending a couple of court hearings in advance, just to become more familiar with what to expect in court and what proper court etiquette looks like. (And remember: any questions you have about proper court procedures can always be addressed to the court clerk. So seek that person out and develop a friendly rapport with him or her.)
Additionally, the intentions of the user may determine which cases they find valuable. For instance, where a legal professional is attempting to argue a specific interpretation of law, he might find a minor court's decision which supports his position more valuable than a senior courts position which does not.[10] He may also value similar positions from different areas of law, different jurisdictions, or dissenting opinions.[10]
James Traficant, the colorful congressman from Ohio, defended himself twice. The first time was on bribery charges during his time as a local sheriff in the early 80s. He succeeded with a daring argument that his bribe-taking was really part of a corruption investigation that he himself was running. The second time didn't work out so well. He was convicted of some impropriety with campaign funds, got kicked out of the House, and went to prison for several years.

A person who is incarcerated or is otherwise in custody pursuant to court order may wish to challenge the fact or duration of his confinement. Such a challenge would be brought as a petition for writ of habeas corpus against the person or entity who holds them in custody, e.g., state or county. If the person can successfully show that a constitutional right was violated, which would have otherwise prevented the incarceration ("fact of incarceration") or the duration of the incarceration the court will grant a writ of habeas corpus.
Certain Municipal Issuers or Conduit Borrowers have determined to participate in the auction of their own auction rate securities pursuant to recent guidance from the U.S. Securities & Exchange Commission. The Connecticut Supreme Court narrowed criminal defendant's right to self representation, stating that "we are free to adopt for mentally ill or mentally incapacitated defendants who wish to represent themselves at trial a competency standard that differs from the standard for determining whether such a defendant is competent to stand trial". A Senior Assistant State's Attorney explained that the new standard essentially allows judges to consider whether the defendants are competent enough to perform the skills needed to defend themselves, including composing questions for voir dire and witnesses.[27][28]

On March 1, 2019 powerful voices of support for the Juliana v. United States youth plaintiffs and their landmark constitutional climate lawsuit filed amicus curiae (“friend of the court”) briefs with the Ninth Circuit Court of Appeals. In all, 15 amicus briefs, filed on behalf of a diverse set of supportive communities, including members of U.S. Congress, legal scholars, religious and women’s groups, businesses, historians, medical doctors, international lawyers, environmentalists, and more than 32,000 youth under the age of 25, displayed legal support for Juliana v. United States to proceed to trial. On March 24 the Ninth Circuit Court of Appeals set a hearing date for June 4, 2019 to hear oral arguments in Portland, Oregon, on the interlocutory appeal and the preliminary injunction.

But in the course of my experience, it became very apparent that the deck was stacked against me just because I was proceeding pro se – that is, representing myself, without an attorney. It's hard enough for a layman to win in court as it is, but the apparent disdain and discrimination that courts and judges show toward pro se litigants make it that much harder.

I did in fact include the notice advising the defendant’s atty of the consequences of the failure to answer the request, as stated in the ORCP 45 Rule. The 30 days allotted by 45 B have elapsed and I have received no response at all, either admitting, denying or objecting to the request. I’m preparing the Motion To Determine Sufficiency, and I will follow your counsel by including a copy of the Request For Admissions, even though I filed a copy with the Court, along with proof of service, on the day I served the request to the defendant’s lawyer. If the Judge grants the motion, issues an Order… well, my case is halfway won. And, I won’t have to drag a handfull of witnesses into court, against their will, to testify. Many times I’ve felt overwhelmed by this, ready to fold my hand even though I know the defendant’s lawyer is bluffing, trying to intimidate me into giving up. Thank you very much for your knowledge, your advice, and your encouragement. I’m thinking I may very well prevail afterall.

Consumers have tried to convince courts to set aside arbitration provisions on the grounds that they are unconscionable and deprive them of their day in court. However, these challenges are not usually successful. For example, under the Federal Arbitration Act, arbitration provisions can trump consumers’ rights to file class action lawsuits. (AT&T Mobility LLC v. Conception, 131 S.Ct. 1740 (2011)).

What are you working on?” He said he told the brothers a short film he had made about a mysterious disappearance in Montauk, and said he was seeking to produce a feature. He told the brothers where to find more information about the project online. He never heard from them again, and assumed they had no interest.
We’re pro se litigants, and we talk to other pro se litigants all day every day, probably more than any lawyer does. I can tell you no one needs to “pit” pro se’s against lawyers; you guys have that covered. The climate response team is made up of senior university administrators who take complaints from students via an online portal that include everything from derogatory comments made on Facebook to student organizations participating in traditions that could be perceived as insensitive. Since September 2017, it has investigated more than 100 reports of "expressions of bias" in posters, fliers, social media, whiteboards and verbal comments, among others, according to the nonprofit's data. The lawsuit says these investigations can result in formal discipline for incidents that include "wide swaths of protected expression."
We strongly recommend that you prepare a trial notebook. A trial notebook is a series of outlines covering matters such as what you must prove (or, if you are a defendant, disprove); the evidence you will use to prove (or disprove) those matters; the topics you intend to cover on direct and cross-examination; a list of the names, addresses, and telephone numbers of your witnesses; and the ­exhibits you plan to introduce into evidence. The notebook serves as your courtroom manager. You can refer to it to make sure that you do not overlook evidence you planned to offer or an argument you intended to make.
Many lawyers routinely ask clients to pay a “retainer”—a deposit or advance fee—that is kept in a trust account and used as services are provided. Your legal coach may ask for a retainer in order to see that you are serious and have the money to pay. However, you shouldn’t be expected to come up with a large amount of money, because you do not plan on running up high legal bills. A fee of more than $500 is excessive, especially before you know whether the legal coach relationship is really working out.
Administrative hearings rather than trials typically result when individuals contest decisions made by government agencies, or when government agencies refuse to act favorably on individuals’ requests. Thanks in part to movies and TV, a popular notion is that in the U.S., trials are the most common method of resolving civil disputes. In fact, across the country many more administrative hearings than trials occur.
The class in each lawsuit covers an approximation of the telcos’ individual customers between April 30, 2015 and February 15, 2019: 100 million for Verizon, 100 million for AT&T, 50 million for T-Mobile, and 50 million for Sprint. Each lawsuit is filed in the name of at least one customer for each telco, and they are seeking unspecified damages to be determined at trial, the complaints read.

Clerk’s staff and judges in Brooklyn now refer pro se litigants to a new on-site center called the Pro Se Legal Assistance Project. There, a small legal staff from the New York City Bar Justice Center helps clients more effectively pursue their cases. The center assists with strategizing, document drafting and procedural guidance, but does not directly represent litigants in court.
Philadelphia, PA: Back in the late 1980s merchant mariners began filing asbestos mesothelioma lawsuits against ship owner and manufacturing defendants in the Northern District of Ohio.
